UNiDAYS Competition Terms & Conditions
Part A – Standard Competition Terms
1. Promoter:
a. The promoter is Myunidays Limited of 2 Castle Boulevard, Nottingham, NG7 1FB, UK.
b. This competition is not sponsored, endorsed, administered by or associated with Apple inc. or its subsidiaries or affiliates in any manner.
2. Eligibility
a. To enter this competition you must be aged 18 years old or over and a resident of Great Britain (being England, Scotland and Wales). By entering the competition, you confirm that you are 18 years old or over and a resident of Great Britain.
b. This competition is not open to:
i. employees of the Promoter or its subsidiary companies;
ii. employees of agents of the Promoter or subsidiary companies, who are professionally connected with the competition or its administration; or
iii. members of the immediate families or households of (i) and (ii) above.
c. The Promoter will not accept and will not count competition entries that are:
i. automatically generated by a computer (including systems which can be programmed to vote) or by macros;
ii. completed by third parties or in bulk;
iii. illegible, have been altered, reconstructed, forged or tampered with; or
iv. incomplete.
d. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
e. There is a limit of one entry to the competition per person.
f. For all competitions run on social media channels, the following eligibility criteria apply (as amended from time to time):
i. Twitter – you must “follow” @UNiDAYS and include an @UNiDAYS mention in your entry;
ii. Facebook – you must “Like” the UNiDAYS Facebook page (https://www.facebook.com/unidays);
iii. Instagram – you must “follow” @UNiDAYS;
iv. Snapchat – you must “follow” UNiDAYS on Snapchat; and/or
v. Tiktok – you must “follow” UNiDAYS (@myunidays) on TikTok.
g. By entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition and if you cannot, you may be disqualified from the competition.
h. If it becomes apparent that a participant is using a computer(s) to circumvent the condition in (2)(c)(i), for example by masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to participate in the competition, that participant will be disqualified and any prize awarded will be void.
3. Acceptance of Terms and Conditions
a. Together the “Part A - Standard Competition Terms” and “Part B - Specific Competition Terms” constitute the Terms and Conditions applicable to the competition.
b. Please read the Terms and Conditions carefully and make sure that you understand them, before taking part in the competition. By submitting a competition entry, you are agreeing to be bound by these Terms and Conditions.
4. Data Protection
a. To enter the competition, the Promoter will collect the following personal data indirectly from you via the TikTok platform - your social media handle and video clip submission that you post and tag the UNiDAYS TikTok account in. This personal data is collected by the Promoter for the purposes of administering the competition, this includes arranging for the competition entries to be judged, selecting the winner(s) and contacting the winner(s) to arrange for the prize(s) to be administered. In collecting this personal data from you, the Promoter is acting as the data controller of your personal data.
b. If you are one of the three winners of the competition, the Promoter will reach out to you via direct message on the TikTok platform and collect the following personal data directly from you - email address. This is in order for the Promoter to email you directly and collect the following additional personal data directly from you - student loan account number, original photo ID (being a passport or driving licence), proof of residence in Great Britain (being a recent utility bill / statement, bank/building society statement, mortgage statement, or local authority council tax statement (no more than three months old)) and
a settlement statement issued by the SLC confirming the total amount you owe to SLC. This personal data is collected by the Promoter for the purposes of administering the competition (including verifying residency eligibility, verifying student loan amount and facilitating the payment of the prize(s)) to the SLC directly on behalf of the winner(s).
c. By entering the competition, you agree that if you win, you will participate, for no additional fee, in any reasonable publicity arranged by the Promoter, its agents or suppliers. This publicity includes publicity on the Promoter’s platform and social media channels.
d. The primary lawful basis upon which the Promoter relies to process your personal data under UK data protection law is performance of a contract - the processing of your personal data is necessary to (i) perform these Terms and Conditions and administer the competition; and (ii) share the winning entries on the Promoter’s platform and social media channels for publicity purposes.
e. The Promoter will retain your personal data for as long as we have an ongoing legitimate business interest to do so (for example, for the performance of the contract with you, to comply with applicable legal, tax or accounting requirements or to protect against fraud). The Promoter may retain your personal data for a longer period to address a complaint or if the Promoter reasonably believes that litigation in respect to our relationship with you is possible. When the Promoter has no ongoing legitimate business interest to process your personal data, the data will be deleted or anonymised.
f. The Promoter will share your personal data with the following parties for the purpose of administering the competition: the Promoter’s affiliates (in the United States, Germany, Australia and India) and third party suppliers. Where your personal data is transferred outside the UK/European Economic Area (EEA) by us or on our behalf, we use appropriate safeguards to protect your personal data. These safeguards include entering into Standard Contractual Clauses for transfers of personal data where applicable. g. By accepting the terms and conditions and entering the competition, you agree that if you win the Promoter will publish your video clip submission on its platform and social media channels for publicity purposes. The Promoter may also publicise your name and county if you win. If you object to your name being published, please contact the Promoter at DPO@myunidays.com. In such circumstances, the Promoter must still provide the information to the Advertising Standards Authority on request.
h. Under UK data protection law, you have various rights (including the right to request from the Promoter access to and rectification or erasure of your personal data or restriction of processing concerning you or to object to processing as well as the right to data portability). Please note certain rights are not not available depending on the lawful basis used to process your personal data (for example the right to object is not available for personal data processed under the lawful basis of performance of a contract). i. If you have any questions about how we handle the personal data that we collect from you, please do not hesitate to contact us at DPO@myunidays.com. 5. Ownership of competition entries and intellectual property rights
a. All competition entries and any accompanying materials (“Entry Materials”) submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.
b. By submitting your competition entry and any accompanying material, you agree to:
i. assign to the Promoter all your intellectual property rights with full title guarantee; and
ii. waive all moral rights,
in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
iii. You agree that Promoter has the rights to reproduce, re-publish, and distribute the Content.
c. Where applicable, by submitting your competition entry you confirm that:
i. the competition entry is an original entry and has not been copied wholly or substantially from any other source;
ii. you are the owner of all rights in the competition entry;
iii. your entry is not defamatory or offensive; and
iv. your entry does not infringe the rights of any third-party.
d. Where applicable, to the extent that your competition entry includes a third-party image, you confirm that any rights arising in such image have been waived for that use. If an image is of a person under 18, parental or guardian consent must be provided.
e. You hereby agree to provide evidence of any required consents at the Promoter’s request. If you fail to provide such evidence, the Promoter may, in its sole discretion, disqualify you from entering the competition.
6. Promoter’s Rights
a. If the Promoter reasonably believes you have breached these Terms and Conditions, the Promoter may exclude you from participating in the competition.
b. The Promoter reserves the right, at its sole discretion, to hold void, suspend or withdraw, the competition at any time, where it becomes necessary to do so as a result of events outside of its control.
7. Limitation of Liability
a. The Promoter accepts no responsibility for withdrawal of the competition, system errors or other issues that may result in disruption to lost, delayed or not received entries or winner notifications that are the result of events outside of the Promoter’s control.
b. The Promoter or its agents will not be responsible for the non-inclusion of entries as a result of technical malfunction, systems, network, server, computer hardware or software failures or otherwise.
c. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the fault of the Promoter, its agents or distributors or that of their employees.

9. Governing law
These Terms and Conditions shall be governed under the laws of England and Wales. Any dispute arising from, or related to, your use of the service shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
Part B – Specific Competition Terms
10. Additional eligibility criteria
This competition is only open to residents of Great Britain (being England, Scotland and Wales) who have a loan(s) and/or interest outstanding with the Student Loans Company Limited (“SLC”) .
11. Entry Mechanics
a. The competition will run from 00.01 BST on 24.06.2024 (the “Opening Date”) to 30.06.2024 (the “Closing Date”) inclusive (“Entry Period”).
b. All competition entries must be received by the Promoter by no later than the Closing Date. All competition entries received after the Closing Date are automatically disqualified.
c. To enter the competition, each entrant must (i) be following UNiDAYS (@myunidays) on TikTok; (ii) create a TikTok video offering a tip to save money or a money saving hack; (iii) add the TikTok video to one of the three (3) TikTok videos promoting the competition using the stitch feature during the Entry Period; and (iv) include the campaign hashtag #BetterDaysWithUNiDAYS in the TikTok video.
Promoter reserves the right to disqualify any entries that include inaccurate or misleading statements about the entrant, or otherwise have missing information or incorrect contact details.
Promoter may contact all entrants directly and investigate any statements made concerning an entry to validate accuracy and veracity. If contacted, entrants must confirm the content of the entry, including without limitation any information, evidence, or other materials submitted or shared with the Promoter. If you are selected as the Prize winner you agree not to announce or publicise your selection until permitted by the Promoter; failure to adhere with this requirement may result in disqualification. All entrants consent to the terms herein. All entrants agree to engage in any promotional activities reasonably requested by Promoter in relation to this competition, including without limitation being interviewed on video.
d. No purchase necessary; however internet connection will be required.
12. The Prize
a. The Prize is £9,000 towards repayment of Prize winner’s student loan(s) owed to the SLC. The Prize winners may be interviewed and profiled by video and written content. This content may be used on the Promoter’s social channels, websites and blogs.
b. There are three (3) Prizes to be won.
c. If the Prize winner’s entire amount of student loan(s) (including accrued but unpaid interest) owed to the SLC is less than £9,000, the Prize will be the repayment of the entire amount of their student loan(s) owed to SLC up to a maximum value of £9,000.
d. In each case, UNiDAYS will only repay student loans owed by the winner(s) to the SLC, a company registered in England and Wales under number 2401034 with its registered address at Memphis Building Lingfield Point, McMullen Road, Darlington, England, DL1 1RW, or any of its subsidiary companies, its holding companies or any subsidiary companies of its holding companies as applicable (each, an associated company) (collectively, the SLC).
e. No loans owed by the winner(s) to any other third party will be eligible to be repaid.
f. In no circumstances shall UNiDAYS be liable for any future amounts any Prize winner may owe to the SLC.
g. Prizes are subject to availability.
h. There is no cash alternative for the prize.
i. The Prize is supplied by UNiDAYS. The Promoter reserves the right to replace the prize with an alternative prize of equal value if circumstances beyond the Promoter’s control make it necessary to do so.
j. The Prize is not negotiable or transferable.
13. Deciding the winner(s)
a. Judging Process: The winning entry will be decided by a panel of judges selected by the Promoter through three rounds of judging. All entries will first be reviewed by a judge from the initial judging panel who will shortlist entries based on how well they fit the Judgement Criteria, the shortlisted entries will then be reviewed by an initial judging panel who will select six (6) finalists based on the Judgement Criteria. The six (6) finalists will then be evaluated by a final round judging panel composed of entirely new judges who will then select the Prize winner based on the Judgement Criteria.
b. Judgement Criteria: Judges will be evaluating entries will determine a winner based on (i) the content and creativity of the video.
c. The decision of the panel of judges (acting reasonably) will be final.
d. Full names of judges will be available upon request for a period of 28 days from the Closing Date.
14. Winner announcement
a. The decision of the Promoter or judges nominated by the Promoter is final and no correspondence or discussion will be entered into.
b. A list of winners (including name, county/region and winning entry) is available for 42 days from the Announcement Date. The list of winners is available upon sending a written request including a stamped self-addressed envelope to the Promoter at: 2 Castle Boulevard, Nottingham, NG7 1FB, UK.
15. Claiming the Prize
a. The winners will be contacted by email on or before the Announcement Date week commencing 8th July, 2024.
b. The Promoter will make all reasonable efforts to contact the winner.
c. The winner will be required to provide, and responsible for providing, UNiDAYS with all information, documentation and authorisation that is reasonably required by the SLC or by UNiDAYS to award the Prize, including but not limited to:
(i) personally attending UNiDAYS’s offices and providing UNiDAYS with the opportunity to take copies of the applicable winner’s (a) original photo ID (being a passport or driving licence; and (b) proof of resident in Great Britain (being a recent utility bill / statement, bank/building society statement, mortgage statement, or local authority council tax statement (no more than three months old). The winner’s reasonable expenses for travelling to UNiDAYS’s office to comply with this condition will be reimbursed by UNiDAYS upon presentation of adequate evidence and upon request.
(ii) providing a settlement statement issued by SLC confirming the total amount owed to SLC by the applicable winner (the “Settlement Amount”) so the applicable winner’s outstanding balance with the SLC can be repaid in full or up to the value of £9,000 (whichever is lower); and
(iii) the winner’s SLC loan account number.
d. The Prize will be paid to the SLC by UNiDAYS directly on behalf of the winner(s) as soon as reasonably practicable after the information, documentation and authorisations listed in condition 15(c) are provided to Reed by each of the winner(s). No payments will be made directly to the winner(s) in any circumstances.
e. The date of payment to the SLC on behalf of each winner will depend on how promptly the information, documentation and authorisations listed in condition 15(c) are provided to UNiDAYS by the winner.
f. Payment of the Prize may take place more than 30 days after the Closing Date.
g. There is no guarantee that any winner will have £9,000 repaid to the SLC by UNiDAYS; the amount repaid will be determined by reference to the amount of the outstanding loan(s) (including accrued but unpaid interest) owed to the SLC by the applicable winner.
h. If the winner:
(i) cannot be contacted or is not available; or
(ii) has not claimed their prize within 7 days of the Announcement Date; or
(iii) does not provide to UNiDAYS within [X] days of its request, all information, documentation and authorisation that is reasonably required by the SLC or by UNiDAYS to award the Prize (including, for the avoidance of doubt, the settlement statement);
the Promoter reserves the right to offer the prize to an alternate entrant selected in the same manner (a “Reserve Winner”).
i. Each of the winners will be solely responsible for the payment of: (i) any tax; or (ii) other liabilities payable to His Majesty’s Revenue and Customs or any other tax authority, in connection with the amount paid to the SLC on the applicable winner’s behalf.
j. The prize may not be claimed by a third party on your behalf.
k. The Promoter does not accept any responsibility if you are not able to take up the Prize.
