1. Promoter and Prize Supplier.

The promoter of this Giveaway is Myunidays Limited, registered at 2 Castle Boulevard, Nottingham, NG7 1FB, UK (the “Promoter”). The prize supplier is the company that has created the Giveaway and will administer and fulfil the Giveaway (“Prize Supplier”).

This Giveaway is not sponsored, endorsed, administered by or associated with Apple Inc., its subsidiaries or affiliates or any other brand or its subsidiaries or affiliates in any manner.

This Giveaway is not sponsored, endorsed, administered by or associated with Instagram, Meta Platforms, Inc., its subsidiaries or affiliates or any other brand or its subsidiaries or affiliates in any manner.

2. Eligibility.

1. a. To enter this Giveaway, entrants must be at least 18 years of age and a resident of United States. The Giveaway is free to enter and no purchase is necessary.
2. b. By submitting an entry, you are agreeing to be bound by these Terms and Conditions. If you wish to opt out you can do so by emailing help@myunidays.com.
3. This Giveaway is not open to:
   1. employees of the Promoter or its subsidiary companies,
   2. employees of agents of the Promoter or other companies who are professionally connected with the Giveaway or its administration; and/or members of the immediate families of such ineligible individuals.
4. d. The Promoter will not accept and will not count Giveaway entries that are:
   1. automatically generated by a computer (including systems which can be programmed to vote) or by macros;
   2. completed by third parties or in bulk;
   3. illegible, have been altered, reconstructed, forged or tampered with;
   4. incomplete; or
   5. on behalf of another person.
5. e. Entrants must be the rightful holder of a verified UNiDAYS® account at all times.
6. f. For all Giveaways involving social media channels, the following eligibility criteria apply (as amended from time to time):
   1. Twitter: “follow” @UNiDAYS and include an @UNiDAYS mention in the entry;
   2. Facebook: “like” the UNiDAYS Facebook page (https://www.facebook.com/unidays);
   3. Instagram: “follow” @UNiDAYS; and/or
   4. Snapchat: “follow” UNiDAYS on Snapchat.
7. g. By entering the Giveaway, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the Giveaway and if you cannot, you may be disqualified.
8. h. If it becomes apparent that an entrant has violated the terms herein, such entrant may be disqualified and any related prize awarded may be voided.

3. Entry Mechanics.

a. The Giveaway will run from Monday 1st July 2024 at 10:00 EDT to Wednesday 17th July 2024 at 23:59 EDT (the “Entry Period”).

b. To enter the Giveaway, entrants must sign up to Amazon Prime Student via the link designated by Unidays (the “Link”) during the Entry Period in order to be automatically entered to win a prize. The Amazon Prime Student subscription must be a new Amazon Prime Student subscription. Individuals who already hold an Amazon Prime Student Subscription prior to the entry Period are not eligible to win the Prize.

c. All Giveaway entries must be received by the Promoter within the Entry Period. All entries received after the Entry Period are disqualified.

d. Entrants understand that by signing up to Amazon Prime Student via the Link, they are selecting to enter this Giveaway. If an entrant would like to revoke their entry into the contest they should contact help@myunidays.com and inform them they wish to be removed from the contest.

e. No purchase is necessary. Internet connection may be required.

4. The Prize

1. a. Thirteen (13) Prize Winners will be randomly selected from the entrants who have entered the Giveaway during the Entry Period (“Prize Winners”).
2. b. Each Prize Winner will be required to provide evidence of signing up to Amazon during the Entry Period.
3. c. Each Prize Winner who completes the Prize Redemption Process will receive Apple AirPods Pro (2nd generation) (approximate real value of £250.00) (“Prize”).
4. d. The Prize is subject to availability. Prize Winners will be contacted by email and requested to provide a delivery address for the prize to be supplied. The Prize may have separate terms and conditions provided by the merchant; UNiDAYS does not control such terms and conditions and disclaims all liability in respect the terms and conditions provided by the Prize Provider or associated with the redemption of the Prize.
5. e. There is no cash alternative for the Prize. The Prize is not negotiable or transferable.
6. f. The Promoter reserves the right to replace the prize with an alternative prize of equal or greater value where it becomes necessary to do so.

5. Deciding and Announcing the Winner(s).

1. a. The Prize Winners will be randomly selected from the list of entrants who have opted in to the Giveaway during the Entry Period and will be notified within 24 hours of completion of the Prize Redemption Process (the “Announcement Date”).
2. b. The decisions of the Promoter are final.
3. c. A list of winners (including surname, county/region and winning entry) will be available for 90 days from the Announcement Date. The list of winners is available upon sending a written request including a stamped self-addressed envelope to the Promoter at: 2 Castle Boulevard, Nottingham, NG7 1FB, UK. If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
4. d. The winner(s) will be contacted by email within 30 days of the Announcement Date. The Promoter will make reasonable efforts to contact the winner. If the winner cannot be contacted, is not available, does not respond, has not claimed their prize, or, if requested, does not provide proof of eligibility within 7 days of email, the Promoter reserves the right to offer the prize to an alternate entrant selected in the same manner.
5. e. The prize may not be claimed by a third party on your behalf.
6. f. The Promoter does not accept any responsibility if you are not able to accept or utilise the prize.
7. g. Each Prize Winner must provide proof of eligibility (including proof of signing up for a new Amazon Prime Student Account) and details for the delivery of the Prize (“Prize Redemption Process”) within the time period allotted in Clause 5(d)

6. Data Protection.

a. By entering the Giveaway, the Promoter will collect the following personal data indirectly from you as a result of you being logged into your UNiDAYS account when you enter the Giveaway - the unique UNiDAYS member ID associated with your UNiDAYS account. This personal data is collected by the Promoter for the purpose of administering the Giveaway, this includes randomly selecting Prize Winners from a list of UNiDAYS Members who have entered into the Giveaway.

b. If you are one of the Prize Winners of the Giveaway and you receive a Winner Message on the UNiDAYS app, when you complete the Prize Redemption Process, the Promoter will collect the following additional personal data directly from your email message - email address, proof of Amazon Prime Student Subscription and your address for the purposes of verifying your UNiDAYS membership status, eligibility to enter the Giveaway and administering the Giveaway which includes facilitating the delivery of the Prize.

c. In processing personal data about you, the Promoter is acting as the data controller of your personal data.

d. By entering the Giveaway, you agree that if you win, you will participate, for no additional fee, in any reasonable publicity arranged by the Promoter, its agents or suppliers. This publicity includes publicity on the Promoter’s platform and social media channels.

e. The primary lawful basis upon which the Promoter relies to process your personal data under data protection law is performance of a contract - the processing of your personal data is necessary to (i) perform these Terms and Conditions and administer the Giveaway; and (ii) share the winning entries on the Promoter’s platform and social media channels for publicity purposes.

f. The Promoter will retain your personal data for as long as we have an ongoing legitimate business interest to do so (for example, for the performance of the contract with you, to comply with applicable legal, tax or accounting requirements or to protect against fraud). The Promoter may retain your personal data for a longer period to address a complaint or if the Promoter reasonably believes that litigation in respect to our relationship with you is possible. When the Promoter has no ongoing legitimate business interest to process your personal data, the data will be deleted or anonymised.

g. The Promoter will share your personal data with the following parties for the purpose of administering the Giveaway: the Promoter’s affiliates (in the United States, Germany, Australia and India) and third party partners and suppliers. Where your personal data is transferred outside the UK/European Economic Area (EEA) by us or on our behalf, we use appropriate safeguards to protect your personal data. These safeguards include entering into Standard Contractual Clauses for transfers of personal data where applicable. h. Under UK data protection law, you have various rights (including the right to request from the Promoter access to and rectification or erasure of your personal data or restriction of processing concerning you or to object to processing as well as the right to data portability). 7. Ownership of Giveaway Entries and Intellectual Property Rights.

1. a. All Giveaway entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.
2. b. In accordance with all applicable laws, by submitting your entry and any accompanying materials, you agree to (i) assign to the Promoter all relevant intellectual property rights, and (ii) waive all moral rights in and to your entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
3. c. Where applicable, by submitting your entry, you confirm that:
   1. the entry is an original entry and has not been copied wholly or substantially from any other source;
   2. you are the owner of all rights in the entry;
   3. your entry is not defamatory or offensive; and
   4. your entry does not infringe the rights of any third-party.
4. d. Where applicable, to the extent that your Giveaway entry includes a third-party image, you confirm that any rights arising in such image have been waived for that use. If an image is of a person under 18, parental or guardian consent must be provided.
5. e. You hereby agree to provide evidence of any required consents at the Promoter’s request. If you fail to provide such evidence, the Promoter may, in its sole discretion, disqualify you from the Giveaway.

8. Promoter’s Rights.

1. a. If the Promoter, in its sole discretion, believes you have breached these Terms and Conditions, the Promoter may exclude you from participating in the Giveaway and/or refuse to deliver you a prize.
2. b. The Promoter reserves the right, at its sole discretion, to hold, void, suspend, amend, or withdraw the Giveaway where necessary.

9. Limitation of Liability; Releases.

1. a. The Promoter accepts no responsibility for withdrawal, cancellation, or modification of the Giveaway or system errors or other issues that may result in disruption and/or lost, delayed or incomplete entries or winner notifications.
2. b. The Promoter and its agents will not be responsible for issues related to entries as a result of technical malfunction, system issues, network issues, server issues, computer hardware issues, or software failures or otherwise.
3. c. Insofar as is permitted by law, the Promoter will not, in any circumstances, (i) be responsible or liable for to compensate the winner or (ii) accept any liability for any loss, damage, personal injury or death occurring as a result of the prize or anything related to the Giveaway, except where it is caused by the negligence of the Promoter.
4. d. Insofar as is permitted by law, by entering the Giveaway, each entrant releases and discharges the Promoter and any other party associated with the development or administration of the Giveaway from any and all liability whatsoever in connection with the Giveaway.

11. Severability.

If any of these terms is found to be unenforceable, illegal, or invalid, such provision shall be limited or eliminated to the minimum extent necessary so that the terms shall otherwise remain in full force and effect and enforceable.

12. Governing Law.

These Terms and Conditions shall be governed under the laws of England and Wales. Any dispute arising from, or related to, your use of the service shall be subject to the jurisdiction of the courts of England and Wales.
